Arbitration
Arbitration is a flexible and confidential dispute resolution process that entrusts an arbitrator with the task of settling a dispute in accordance with the rules of law and, where appropriate, determining the damages that may be awarded.
This type of dispute resolution procedure enables you to be heard by an arbitrator appointed by the parties on the basis of his or her expertise, and results in an arbitral award which, subject to narrow grounds for challenge, cannot be appealed as in a court of law.
It is possible to follow a different procedure to that of the courts.
For monetary stakes or stakes that can be negotiated on a continuum, it is possible to proceed according to the specific procedure of final offer arbitration (“baseball arbitration”), with or without prior mediation (MEDALOA : Mediation And Last Offer Arbitration).
It is also possible to draft an arbitration clause for your contract.
