Intervention from a third-party in a trial
As a member of society, you don’t have to “stand on the sidelines” when an issue being debated in court could affect you.
Whether you are an individual or an organization, there are certain ways you can intervene in a lawsuit if the issue at the heart of the case or its outcome will affect you.
There are several types of intervention:
-
It is possible to join a party to assist them and support their claims, with the aim of providing assistance and support: a conservatory intervention.
-
It is also possible to seek recognition of a right that is being contested and thus seek relief against the defendant: an aggressive intervention.
-
It is even possible to intervene solely during oral arguments to enrich the Court’s deliberations and provide it with a perspective distinct from that already offered by the parties: a friendly intervention.
An intervention can be done at the trial level as well as during an appeal.
